GENERAL TERMS OF USE
GENERAL ASPECTS
Definitions
For the purposes of these Terms of Use, the expressions below shall have the following meanings when used in capital letters, whether in the singular or plural:
Restricted Activities:
A set of activities, practices, products, or services whose execution, offering, or commercialization is prohibited on the Mundpay Platform, pursuant to these Terms of Use, Mundpay’s internal policies, and applicable law.
Chargeback or Dispute:
A request for cancellation, reversal, or refund of a transaction carried out via credit card, submitted by the cardholder to the issuer or card network. The dispute is communicated to the acquirer or sub-acquirer responsible for the transaction, which notifies Mundpay. If the dispute is accepted by the card issuer, the corresponding amount is refunded to the cardholder.
Seller:
An individual or legal entity that uses the Mundpay Platform to sell Digital Products or Services and receive payments resulting from such transactions. The Seller is responsible for the accuracy of the information provided, the delivery of products and services to customers, the legal compliance of its activities, and full compliance with this Agreement.
Affiliate:
An individual or legal entity that, upon authorization from the Seller, promotes or advertises Products or Services through digital marketing strategies, assuming responsibility for its conduct, compliance with applicable rules, and adherence to guidelines established by the Seller and Mundpay. The Affiliate is not part of the contractual relationship between the Seller and Mundpay and is solely responsible for its actions and communications before consumers and authorities.
User:
A broad term designating any individual or legal entity that uses the Mundpay Platform, including Sellers, Affiliates, buyers, or any third party that accesses or interacts with the services made available. Each User is responsible for the accuracy of the information provided, compliance with contractual rules, ethical conduct, and adherence to applicable law.
Affiliate User:
An individual or legal entity that promotes, advertises, or sells third-party digital products, using the Mundpay Platform for processing, intermediation, and management of transactions.
Buyer User:
An individual or legal entity that acquires digital products made available by Producers and/or Affiliates, using the Mundpay Platform for payment processing.
Producer User:
An individual or legal entity that sells digital products owned by them or for which they hold valid authorization for the exploitation of intellectual property rights, using the Mundpay Platform for processing and managing transactions.
Marketplace:
A digital environment operated by a third party where different Sellers can offer their products and services, with Mundpay acting as a payment facilitator, processing transactions and settling amounts due, as applicable. The Marketplace is responsible for its relationship with its Sellers and for the compliance of the offers made on its platform.
Platform:
The technological environment made available and operated by Mundpay, consisting of systems, APIs, interfaces, and other digital resources intended for payment intermediation and processing, financial management, technical support, and other functionalities provided for in this Agreement. It also includes security tools, encryption, and protocols suitable for handling national and international transactions.
Restricted and Prohibited Activities:
A set of activities, products, services, or practices that are prohibited or limited on the Mundpay Platform, in accordance with these Terms of Use, Mundpay’s internal policies, card network rules, regulations of the Central Bank of Brazil, and other applicable laws. The User undertakes to fully comply with such restrictions, under penalty of suspension, retention of funds, or account termination.
Bank Account:
A financial account owned by the User, registered and validated on the Platform, intended to receive funds from transactions processed by Mundpay. The accuracy of the Bank Account data is the sole responsibility of the User.
Fee or Charge:
Compensation owed by the User to Mundpay for intermediation, processing, settlement, risk management, support, and other functions made available on the Platform. Fees are applied in accordance with the current commercial model and the conditions set forth in this Agreement.
Taxes:
Tax obligations applicable to the activities carried out by the User, including taxes, fees, contributions, and other fiscal charges. The calculation, assessment, payment, and tax compliance are entirely the responsibility of the User, with no joint or subsidiary liability of Mundpay.
Transaction:
A financial operation initiated by the Buyer and processed by the Platform, involving authorization, capture, settlement, reversal, dispute, or any related movement, including the principal amount and applicable fees. It is considered completed only after final settlement.
Net Balance:
The amount available to the User after automatic deduction of fees, charges, commissions, amounts owed to Affiliates, refunds, chargebacks, security reserves, blocks, and operational charges.
Security Reserve / Rolling Reserve:
An amount retained by Mundpay preventively or correctively to cover risks of chargebacks, disputes, fraud, penalties, or operational inconsistencies. It may be applied for a fixed or indefinite period, according to risk assessment.
Payout / Transfer / Settlement:
The process by which Mundpay transfers the available Net Balance in the User’s Virtual Account, subject to deadlines, criteria, blocks, minimum amounts, and security conditions set forth in these Terms of Use.
Refund:
A voluntary or compulsory reversal of a transaction, carried out by Mundpay to the Buyer, whether at the request of the Seller, by Mundpay’s decision, or by legal determination, and not to be confused with a chargeback.
KYC (Know Your Customer) / Account Verification:
Identification and document validation procedures required for opening, maintaining, and using the Account, including identity verification, legal documentation, and compliance checks, which may result in account suspension or termination in case of inconsistencies.
Suspicious Transactions:
Atypical movements or those incompatible with the User’s profile, including disproportionate volumes, multiple failed attempts, fraud patterns, misuse of the Platform, high chargeback rates, or potentially unlawful activities, according to objective compliance and risk monitoring criteria.
Maintenance Windows:
Periods previously informed or necessary for updates, performance improvements, bug fixes, security, and technological evolution of the Platform, which may result in full or partial unavailability of services.
Scheduled Downtime:
Temporary interruption of services due to technical, operational, or security needs, either previously communicated or arising from emergency events, not constituting a failure in service provision.
API / Technology Integrator:
A programming interface provided by Mundpay for integration with third-party systems, with the User or developer being solely responsible for proper implementation, maintenance, security, and use of the resources.
Applicability and Acceptance of the Terms
These Terms of Use apply to all websites, digital platforms, systems, interfaces, applications, and other electronic means made available by Mundpay, as well as to all individuals or legal entities who access or use them as Users.
Accessing, browsing, or using any feature of the Platform implies full, express, and unequivocal acceptance of these Terms of Use, which constitute a legally binding agreement between the User and Mundpay. If the User does not agree with any of the provisions herein, they must immediately discontinue access to or use of the Platform.
These Terms govern access to and use of the Platform at both national and international levels, subject to applicable legal, regulatory, technical, and operational limitations. Certain services, features, or resources may not be available in all jurisdictions or to all Users, in accordance with regulatory requirements, internal risk policies, and compliance obligations.
Scope of the Platform and Services
These Terms of Use constitute a legally binding agreement between the User and Mundpay and govern access to and use of the website https://mundpay.com/, its subdomains, as well as any other digital environments, interfaces, applications, systems, or electronic means through which Mundpay makes its products, services, functionalities, and resources available, including applications for mobile devices, tablets, or other electronic equipment. This also includes all services, operations, and functionalities related to or integrated with the Mundpay Platform.
The Mundpay group entity effectively contracted by the User to access the Platform and process transactions may vary depending on the nature of the operation, the country or countries of residence of the User(s), the applicable jurisdiction, and the currency in which the transaction is conducted. For regulatory and contractual transparency purposes, Mundpay has headquarters, branches, and/or representatives in the following jurisdictions:

The identification of the entity responsible for providing services to the User will be defined according to the specific transaction, in compliance with the legal, regulatory, foreign exchange, and compliance requirements applicable in each jurisdiction.
Supplementary Policies
The User declares awareness of and agreement with these Terms of Use, as well as all applicable Mundpay institutional policies, including but not limited to the Privacy Policy, Anti-Money Laundering (AML) policies, Fraud Prevention, Information Security, and other internal compliance rules.
Such policies form an integral part of these Terms for all legal purposes, even if provided in separate documents. In the event of conflict between these Terms and any Mundpay policy, the provisions of these Terms shall prevail, unless expressly stated otherwise due to legal or regulatory requirements.
These Terms and any updates thereto replace and prevail over any prior understandings, proposals, communications, or agreements, whether verbal or written, entered into between the User and Mundpay.
Data Processing and Information
The User acknowledges and expressly authorizes that their personal and registration data, including identification, contact, banking information, access logs, and transactional data, may be collected, used, stored, and processed by Mundpay in accordance with applicable laws, including Brazil’s General Data Protection Law (LGPD), the Consumer Protection Code, and other applicable regulations, for the purposes of service execution, compliance with legal and contractual obligations, fraud and illicit activity prevention, risk management, governance, and the regular exercise of rights.
The User agrees that such data may be shared, within legal limits, with competent authorities upon formal request, as well as with business, technological, operational partners, financial institutions, insurers, auditors, and service providers when necessary for service provision, security, or auditing.
Data may also be shared with parties directly involved in transactions, disputes, mediations, investigations, or compliance procedures when necessary for fact-finding, conflict resolution, damage prevention, or legal obligations, without prior notice to the User and without generating any right to compensation, provided such actions are taken in good faith and in strict compliance with legal or regulatory duties.
Mundpay undertakes to maintain the confidentiality of information and to adopt appropriate technical, administrative, and organizational measures, in line with market standards, to protect it against unauthorized access, loss, alteration, or improper disclosure.
The User acknowledges that, in the face of legal, operational, regulatory, or reputational risks—including those with potential national or international media impact—Mundpay may use, retain, and, when necessary, share strictly necessary data to protect its rights, institutional image, partners, and third parties. This may include actions to collect outstanding debts, including in cases of negative account balances.
Nothing in this instrument implies waiver of legal rights or assumption of liability beyond legal limits, preserving contractual balance, good faith, and transparency. Detailed information on purposes, legal bases, data subject rights, and security measures is available in Mundpay’s Privacy Policy.
Preservation of Rights and Non-Waiver
Any tolerance, omission, or failure by Mundpay to exercise rights provided for in these Terms, applicable laws, or regulations shall not constitute waiver, novation, or contractual amendment. Mundpay may exercise such rights at any time at its sole discretion, within legal limits.
Any specific waiver of a right shall not imply waiver of other rights, nor affect the enforceability of other provisions of these Terms.
Mundpay’s Activity
The legal relationship between the User and Mundpay will be defined by the group entity effectively contracted to enable Platform access and process transactions, considering jurisdiction, operation nature, and currency.
By accepting these Terms, the User grants Mundpay the necessary powers to perform activities related to maintaining the business relationship, contractual compliance, and adherence to internal and regulatory policies.
Mundpay acts exclusively as a provider of technological and operational services for the intermediation and management of electronic transactions, not performing activities exclusive to financial institutions, nor granting credit, managing cards, accepting deposits, or directly providing financial services.
Regarding operational models:
In Brazil, Mundpay primarily acts as a Marketplace / Intermediation Platform, providing infrastructure to connect Buyers, Sellers, Producers, and Affiliates, enabling transactions without integrating the supply chain.
In the United States and Europe, Mundpay may act as a Merchant of Record (MoR), assuming formal responsibility for financial transaction processing with acquirers, card networks, issuers, and partners, without assuming responsibility for the nature, quality, delivery, or legality of products or services offered.
ETHOCA and VERIFI Alert Services
The Ethoca and Verifi Alert Services, affiliated with the Mastercard network, apply to Mundpay Clients subject to chargeback risks arising from transactions carried out with cardholders.
These services aim to mitigate risks and reduce chargeback rates and consist, exclusively for transactions carried out with Mastercard and Visa cards, of receiving real-time fraud and refund alerts, allowing the Client to take preventive measures.
The Client acknowledges and agrees that all transactions subject to alerts, once received or confirmed, may be automatically refunded. For each refund carried out due to Ethoca or Verifi alerts, a fee of up to BRL 150.00 (one hundred and fifty reais) may be charged, which will be debited upon receipt of the alert by Mundpay.
This fee may be adjusted annually in June based on the positive variation of the IGPM-FGV index accumulated over the previous 12 months or, if discontinued, by another official index that replaces it.
If the Client exceeds a 1% (one percent) chargeback rate, Mundpay may, at its sole discretion, apply additional fees for continued use of payment services, as well as adopt risk mitigation measures, including suspension or deactivation of the account and blocking of funds for up to 120 (one hundred and twenty) days, without prejudice to other penalties provided for in these Terms.
Affiliate Compensation and CPA Payment Conditions
The Affiliate acknowledges that their compensation may occur under two models:
(i) percentage-based compensation calculated on the value of transactions processed through their referral link; and
(ii) fixed compensation per acquisition (CPA — Cost Per Acquisition), subject to a minimum requirement by the Producer/Seller.
CPA payments will only be made when the Producer responsible for the product has accumulated a minimum balance of USD 1,000.00 (one thousand US dollars) in sales of that product on the Platform.
Until this threshold is reached, CPA payments will be suspended, with no compensation or adjustment owed. Mundpay assumes no responsibility for non-payment of CPA during this period.
USER REGISTRATION
User Registration and Eligibility Requirements
Individuals and legal entities may register as Users (Producer, Affiliate, Creator, Co-producer, Collaborator, or Buyer) provided they meet legal requirements and Mundpay policies.
Individuals must be at least 18 years old or legally emancipated. Legal entities must be represented by authorized individuals with sufficient legal powers.
Buyers may register from the age of 13, with authorization from legal guardians for minors between 13 and 18.
Mundpay may refuse or cancel registrations of individuals involved in criminal activities, fraud, money laundering, terrorism financing, or other unlawful conduct.
User Information and Access Credentials
The User declares that all provided information is accurate and assumes full responsibility for it.
Access credentials are personal, confidential, and non-transferable. The User is solely responsible for their security and any activity conducted through their account.
Mundpay is not liable for damages resulting from unauthorized use of credentials.
Registration Verification
Mundpay may take up to 72 business hours to verify user data and may perform additional checks using public or private databases.
Accuracy of Information
The User is fully responsible for the accuracy of their data and any damages resulting from incorrect or misleading information.
Transparency and Third-Party Relationships
Users must provide clear, complete, and transparent information about products and services.
They are fully responsible for third parties involved (partners, influencers, service providers, etc.) and must ensure compliance with laws and Mundpay policies.
Politically Exposed Persons (PEP)
Mundpay does not accept Sellers who are PEPs or related to PEPs.
Users must declare they are not PEPs and must notify Mundpay if this status changes.
Failure to comply may result in immediate account termination and fund retention.
PRODUCT AND SERVICE REGISTRATION
Product Registration and Prohibited Activities
Only legal and compliant products/services may be offered.
Violations may result in immediate freezing of funds and account suspension.
Transparency and Product Claims
False or misleading claims, especially regarding financial gains, are prohibited.
Health-related products must have proper scientific backing and regulatory approvals.
High-Risk Jurisdictions
Mundpay does not operate with sanctioned countries (e.g., Iran, North Korea, Syria, etc.) or individuals on sanctions lists.
Prohibited Uses
Users may not:
Provide false data
Process fake transactions
Use the platform improperly (e.g., as a card testing tool)
Misuse Mundpay’s intellectual property
Platform Integrity
Users must not attempt to hack, manipulate, or exploit the platform.
Spam, malware, or abusive marketing practices are prohibited.
Mundpay Promotion Disclaimer
Mundpay may promote products but does not endorse or guarantee them.
INTELLECTUAL PROPERTY PROTECTION
Mundpay Ownership
All intellectual property related to Mundpay belongs exclusively to the company.
Unauthorized use, reproduction, or exploitation is strictly prohibited.
Brand and Identity
Domain names, trademarks, and visual identity elements are legally protected.
Improper Association
Users may not imply false partnerships, endorsements, or affiliations with Mundpay.
License Granted by Users
Users grant Mundpay a non-exclusive, global, royalty-free license to use content for platform operation and promotion.
Unfair Competition
Users must not engage in deceptive practices, brand imitation, or customer diversion.
Parasitism and Domain Misuse
It is prohibited to:

Use confusing brand variations
Engage in cybersquatting or brand bidding
Penalties
Violations may result in:
Account suspension
Fund retention
Content removal
Contract termination
Legal actions and damages may also apply.
Third-Party Rights
Users are responsible for ensuring their content does not violate third-party rights.
Copyright Complaints
Complaints must be sent to: contato@mundpay.com.br with proper documentation.
Mundpay will investigate and take appropriate action.

Immediate Measures
Mundpay may suspend or block content immediately in urgent cases.
In such cases, the Notified Party shall not be entitled to any form of compensation and hereby acknowledges and agrees to the terms set forth herein.
The Producer whose infoproduct has been blocked shall be granted the right to submit a subsequent statement, presenting any clarifications and documents deemed relevant, should they consider the measure improper.
REFUNDS
fund requests may be submitted by the Buyer within the product’s guarantee period through the link provided by the platform: https://mundpay.com/ajuda-contato/. If the request is made within the applicable period, it will be processed automatically by the platform.
Mundpay, regardless of prior consultation with or consent from the Producer, reserves the right to intervene and directly issue a refund to the Buyer whenever it identifies circumstances that may compromise proper service delivery, good faith in consumer relations, or the regularity of offers available on the platform.
This prerogative may also be exercised when the Buyer reports lack of response or absence of support from the Producer, as well as in cases where customer support channels are found to be invalid, nonexistent, or inoperative.
Likewise, Mundpay may process refunds in the event of complaints or incidents initiated through administrative, extrajudicial, or judicial channels including, but not limited to, consumer protection agencies or public complaint platforms whenever such occurrences indicate risks to consumer experience, platform reputation, or regulatory compliance.
This measure may also be adopted in cases of suspected or confirmed fraud, plagiarism, copyright infringement, abusive practices, misleading claims regarding product characteristics or results, bad faith conduct, or any similar irregular practices.
Finally, Mundpay may issue refunds in cases of non-delivery, non-availability, or failure by the Producer to comply with delivery or access conditions as advertised.
CHARGEBACKS
Mundpay, as a payment intermediary and participant in the payment ecosystem, adopts risk management, fraud prevention, loss mitigation, and financial integrity protection mechanisms for transactions processed on its platform.
In this context, it reserves the right to retain funds from transactions carried out by the Merchant/Producer for up to 120 (one hundred and twenty) days, through the establishment of an initial financial reserve of 20% (twenty percent) of the transacted amount, intended to cover chargebacks, disputes, refunds, cancellations, and related events.
The retention percentage may be revised and increased, including retroactively, up to 100% (one hundred percent) of the transacted amounts, whenever there are indications of a disproportionate increase in chargeback rates, abnormal dispute levels, abrupt transaction volume changes, or any elements indicating increased operational, financial, or reputational risk.
The adoption of a retroactive reserve aims to safeguard operational sustainability, payment system stability, and the ability to cover contingent liabilities. The release period for any increased reserve will be assessed on a case-by-case basis.
The retention period may also be extended in the event of ongoing judicial, administrative, or arbitration proceedings related to transactions, lasting until final resolution, including final and unappealable decisions. In such cases, retained funds may be used to offset losses, judgments, settlements, legal costs, and attorney fees.
If suspicious, fraudulent, or high-risk transactions are identified—especially where chargeback rates may exceed 1%—Mundpay may proactively cancel sales and issue refunds to Buyers to mitigate systemic risks.
Similarly, if transaction data is found in fraud databases shared within the payment network, Mundpay may immediately reverse the transaction and debit the User’s Virtual Account.
Once a chargeback is formally notified by payment system participants, the full transaction amount will be immediately debited from the Merchant’s Virtual Account, without prior notice.
At Mundpay’s discretion and in compliance with payment network rules, the Merchant may be granted up to 10 (ten) calendar days to submit a defense with supporting documentation proving the legitimacy of the transaction.
Required documentation may include, among others:
Proof of delivery or service provision
Logistics tracking records
Transaction authentication logs (IP, timestamp, device data, etc.)
Evidence of buyer consent
Communication records with the Buyer
Proof of product access or usage
Applicable commercial policies at the time of sale
Any additional documents requested
Failure to submit documentation within the deadline or submission of insufficient evidence will result in forfeiture of the defense and permanent confirmation of the chargeback.
The final decision on disputes rests exclusively with issuers, card networks, and payment institutions, with Mundpay acting only as an intermediary.
If there are insufficient funds, Mundpay may pursue collection measures, including legal action.
The Producer must maintain adequate post-sale support and is aware that Mundpay continuously monitors chargeback rates.
Chargeback rates below 1% are considered acceptable. Exceeding this threshold may result in fund retention for up to 120 days.
Serious violations may lead to account blocking and full fund retention pending investigation.
Investigations may last up to 120 business days, after which a final decision will be communicated.
In case of contract termination, Mundpay may exercise the right of recourse to recover losses.
ACCOUNT SUSPENSION, BLOCKING, AND TERMINATION
Improper use of the platform or violation of these Terms may result in account suspension, blocking, or termination, applied at Mundpay’s sole discretion.
Examples include:

Security breaches
False information
Spam or abusive advertising
Self-purchases via affiliate links
Intellectual property misuse
High chargeback rates
Fraud suspicion
Repeated complaints
Lack of customer support
Measures may be applied without prior notice and do not entitle the User to compensation.
Account removal prevents new transactions, and prior purchases may be refunded.
SUSPENSION
Suspension consists of a preventive and temporary measure, applied when there are indications of irregularities subject to investigation, correction, or clarification. In such cases, Mundpay may limit the User’s access to the Platform, suspend checkout links, sales pages, offers, operational functionalities, and financial payouts, as well as prevent account changes and new transactions.
In cases of suspected fraud, suspension may be applied preventively for up to 120 (one hundred and twenty) business days or for the entire duration necessary for internal investigation. This period may be extended in the event of judicial, police, or administrative investigations, or whenever the complexity of the case so requires.
During suspension, additional risk mitigation measures may be adopted, including retention of funds from suspicious sales, in order to protect consumers, acquirers, payment arrangements, and Mundpay itself.
BLOCKING
Blocking is a more severe measure, applied when there is evidence of a violation, concrete risk of damage, or significant breach of contractual obligations. It may affect specific products or the entire account, resulting in automatic cancellation of listings and offers, interruption of payment processing, prevention of new sales, and blocking of existing and future balances.
Mundpay may block and retain funds from suspicious transactions for the time necessary for investigation, subject to an initial limit of up to 120 (one hundred and twenty) business days, without prejudice to extension for covering chargebacks, disputes, acquirer penalties, refunds, or damages caused.
If acquirers, processors, or financial institutions determine blocks, reversals, or retentions, Mundpay shall fully comply with such determinations and shall not be liable for any resulting damages.
If there are indications of a significant increase in chargeback rates—especially above market standards or with high future risk—Mundpay may, as a preventive measure, cancel sales, interrupt settlements, and issue refunds to Buyers in order to avoid systemic losses.
TERMINATION
Termination results in the definitive closure of the account and contractual relationship and may occur, especially, in cases of confirmed fraud, repeated violations, serious breach of these Terms, significant harm to the Platform or third parties, legal determinations, or conduct that affects the reputation and security of the Mundpay ecosystem.
In cases of confirmed fraud, the account may be blocked and terminated without prior notice, and Mundpay may retain available and future funds to compensate for damages caused to third parties, consumers, acquirers, or the company itself.
When a violation subject to termination is identified, Mundpay will provide formal notice stating the reasons for the measure, subject to legal confidentiality obligations. The User will be granted a deadline to present a defense, defined according to the complexity of the case. After review, Mundpay will issue a final decision within a previously informed timeframe.
Once termination or early contract rescission is enforced, Mundpay may debit the User’s account for any amounts necessary to cover damages caused. Termination will result in permanent access restriction, prohibition of new accounts, and inability to conduct transactions.
REPORTING AND INTERNAL INVESTIGATION
Mundpay may initiate investigation procedures based on reports from users, third parties, or on its own initiative, regardless of external requests. If a report lacks minimum supporting evidence, it may be summarily dismissed.
If deemed plausible, Mundpay may adopt preliminary measures, including preventive blocking of products or accounts, and notify the reported party to present their version of facts, evidence, and clarifications.
When disputes involve conflicts between users, Mundpay may initiate mediation procedures to seek an amicable resolution. If no agreement is reached, Mundpay may, at its discretion and without obligation, issue an administrative decision to resolve the conflict.
Investigations may be initiated at any time, and their results may be shared with competent authorities when required or deemed necessary to protect rights.
DISCLAIMER AND LIMITATION OF LIABILITY
Nature of Services
All services, functionalities, content, systems, software, and materials provided by Mundpay are offered “as is” and constitute obligations of means, not of result. Mundpay does not guarantee performance, continuity, commercial success, profitability, or suitability for any specific purpose.
No Warranties
To the fullest extent permitted by law, Mundpay disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, system compatibility, absolute security, data accuracy, and absence of harmful components.
The User acknowledges that use of the Platform is at their sole risk.
Scope Limitation
Mundpay acts solely as a technological infrastructure provider and intermediary, not creating, endorsing, or guaranteeing any products, services, or content offered by Users.
All offerings are the sole responsibility of the Users.
Exclusion of Liability
Except where legally required, Mundpay shall not be liable for any direct or indirect damages, including loss of profits, data loss, business interruption, or moral damages.
This includes damages arising from:
Product defects or quality issues
False or misleading information
Failure between Users
Delivery issues or cancellations
Chargebacks and payment system rules
Technical failures or cyberattacks
Unauthorized access or fraud
Third-party services
CUSTOMER SUPPORT
For questions, complaints, or suggestions, Users may contact Mundpay Support via email at contato@mundpay.com, Monday through Friday, from 9:00 AM to 6:00 PM.
FINAL PROVISIONS
Users may not assign or transfer their rights or obligations without prior written consent from Mundpay.
Right of Recourse and Indemnification
The User agrees to fully indemnify Mundpay for any damages, losses, or expenses resulting from their actions, including legal fees, taxes, penalties, and third-party claims.
This obligation extends to Mundpay’s partners, employees, and representatives.
Failure to enforce any provision shall not constitute waiver of rights.
DISPUTE RESOLUTION
The parties agree to attempt amicable resolution before legal or arbitration proceedings.
Jurisdiction
The courts of Rio de Janeiro, Brazil, are elected as the competent forum.
Governing Law
These Terms are governed by Brazilian law.
ARBITRATION (INTERNATIONAL OPERATIONS)
Disputes related to U.S. or European operations shall be resolved by binding arbitration under the Federal Arbitration Act (FAA), administered by the American Arbitration Association (AAA).

GENERAL TERMS OF USE
GENERAL ASPECTS
Definitions
For the purposes of these Terms of Use, the expressions below shall have the following meanings when used in capital letters, whether in the singular or plural:
Restricted Activities:
A set of activities, practices, products, or services whose execution, offering, or commercialization is prohibited on the Mundpay Platform, pursuant to these Terms of Use, Mundpay’s internal policies, and applicable law.
Chargeback or Dispute:
A request for cancellation, reversal, or refund of a transaction carried out via credit card, submitted by the cardholder to the issuer or card network. The dispute is communicated to the acquirer or sub-acquirer responsible for the transaction, which notifies Mundpay. If the dispute is accepted by the card issuer, the corresponding amount is refunded to the cardholder.
Seller:
An individual or legal entity that uses the Mundpay Platform to sell Digital Products or Services and receive payments resulting from such transactions. The Seller is responsible for the accuracy of the information provided, the delivery of products and services to customers, the legal compliance of its activities, and full compliance with this Agreement.
Affiliate:
An individual or legal entity that, upon authorization from the Seller, promotes or advertises Products or Services through digital marketing strategies, assuming responsibility for its conduct, compliance with applicable rules, and adherence to guidelines established by the Seller and Mundpay. The Affiliate is not part of the contractual relationship between the Seller and Mundpay and is solely responsible for its actions and communications before consumers and authorities.
User:
A broad term designating any individual or legal entity that uses the Mundpay Platform, including Sellers, Affiliates, buyers, or any third party that accesses or interacts with the services made available. Each User is responsible for the accuracy of the information provided, compliance with contractual rules, ethical conduct, and adherence to applicable law.
Affiliate User:
An individual or legal entity that promotes, advertises, or sells third-party digital products, using the Mundpay Platform for processing, intermediation, and management of transactions.
Buyer User:
An individual or legal entity that acquires digital products made available by Producers and/or Affiliates, using the Mundpay Platform for payment processing.
Producer User:
An individual or legal entity that sells digital products owned by them or for which they hold valid authorization for the exploitation of intellectual property rights, using the Mundpay Platform for processing and managing transactions.
Marketplace:
A digital environment operated by a third party where different Sellers can offer their products and services, with Mundpay acting as a payment facilitator, processing transactions and settling amounts due, as applicable. The Marketplace is responsible for its relationship with its Sellers and for the compliance of the offers made on its platform.
Platform:
The technological environment made available and operated by Mundpay, consisting of systems, APIs, interfaces, and other digital resources intended for payment intermediation and processing, financial management, technical support, and other functionalities provided for in this Agreement. It also includes security tools, encryption, and protocols suitable for handling national and international transactions.
Restricted and Prohibited Activities:
A set of activities, products, services, or practices that are prohibited or limited on the Mundpay Platform, in accordance with these Terms of Use, Mundpay’s internal policies, card network rules, regulations of the Central Bank of Brazil, and other applicable laws. The User undertakes to fully comply with such restrictions, under penalty of suspension, retention of funds, or account termination.
Bank Account:
A financial account owned by the User, registered and validated on the Platform, intended to receive funds from transactions processed by Mundpay. The accuracy of the Bank Account data is the sole responsibility of the User.
Fee or Charge:
Compensation owed by the User to Mundpay for intermediation, processing, settlement, risk management, support, and other functions made available on the Platform. Fees are applied in accordance with the current commercial model and the conditions set forth in this Agreement.
Taxes:
Tax obligations applicable to the activities carried out by the User, including taxes, fees, contributions, and other fiscal charges. The calculation, assessment, payment, and tax compliance are entirely the responsibility of the User, with no joint or subsidiary liability of Mundpay.
Transaction:
A financial operation initiated by the Buyer and processed by the Platform, involving authorization, capture, settlement, reversal, dispute, or any related movement, including the principal amount and applicable fees. It is considered completed only after final settlement.
Net Balance:
The amount available to the User after automatic deduction of fees, charges, commissions, amounts owed to Affiliates, refunds, chargebacks, security reserves, blocks, and operational charges.
Security Reserve / Rolling Reserve:
An amount retained by Mundpay preventively or correctively to cover risks of chargebacks, disputes, fraud, penalties, or operational inconsistencies. It may be applied for a fixed or indefinite period, according to risk assessment.
Payout / Transfer / Settlement:
The process by which Mundpay transfers the available Net Balance in the User’s Virtual Account, subject to deadlines, criteria, blocks, minimum amounts, and security conditions set forth in these Terms of Use.
Refund:
A voluntary or compulsory reversal of a transaction, carried out by Mundpay to the Buyer, whether at the request of the Seller, by Mundpay’s decision, or by legal determination, and not to be confused with a chargeback.
KYC (Know Your Customer) / Account Verification:
Identification and document validation procedures required for opening, maintaining, and using the Account, including identity verification, legal documentation, and compliance checks, which may result in account suspension or termination in case of inconsistencies.
Suspicious Transactions:
Atypical movements or those incompatible with the User’s profile, including disproportionate volumes, multiple failed attempts, fraud patterns, misuse of the Platform, high chargeback rates, or potentially unlawful activities, according to objective compliance and risk monitoring criteria.
Maintenance Windows:
Periods previously informed or necessary for updates, performance improvements, bug fixes, security, and technological evolution of the Platform, which may result in full or partial unavailability of services.
Scheduled Downtime:
Temporary interruption of services due to technical, operational, or security needs, either previously communicated or arising from emergency events, not constituting a failure in service provision.
API / Technology Integrator:
A programming interface provided by Mundpay for integration with third-party systems, with the User or developer being solely responsible for proper implementation, maintenance, security, and use of the resources.
Applicability and Acceptance of the Terms
These Terms of Use apply to all websites, digital platforms, systems, interfaces, applications, and other electronic means made available by Mundpay, as well as to all individuals or legal entities who access or use them as Users.
Accessing, browsing, or using any feature of the Platform implies full, express, and unequivocal acceptance of these Terms of Use, which constitute a legally binding agreement between the User and Mundpay. If the User does not agree with any of the provisions herein, they must immediately discontinue access to or use of the Platform.
These Terms govern access to and use of the Platform at both national and international levels, subject to applicable legal, regulatory, technical, and operational limitations. Certain services, features, or resources may not be available in all jurisdictions or to all Users, in accordance with regulatory requirements, internal risk policies, and compliance obligations.
Scope of the Platform and Services
These Terms of Use constitute a legally binding agreement between the User and Mundpay and govern access to and use of the website https://mundpay.com/, its subdomains, as well as any other digital environments, interfaces, applications, systems, or electronic means through which Mundpay makes its products, services, functionalities, and resources available, including applications for mobile devices, tablets, or other electronic equipment. This also includes all services, operations, and functionalities related to or integrated with the Mundpay Platform.
The Mundpay group entity effectively contracted by the User to access the Platform and process transactions may vary depending on the nature of the operation, the country or countries of residence of the User(s), the applicable jurisdiction, and the currency in which the transaction is conducted. For regulatory and contractual transparency purposes, Mundpay has headquarters, branches, and/or representatives in the following jurisdictions:

The identification of the entity responsible for providing services to the User will be defined according to the specific transaction, in compliance with the legal, regulatory, foreign exchange, and compliance requirements applicable in each jurisdiction.
Supplementary Policies
The User declares awareness of and agreement with these Terms of Use, as well as all applicable Mundpay institutional policies, including but not limited to the Privacy Policy, Anti-Money Laundering (AML) policies, Fraud Prevention, Information Security, and other internal compliance rules.
Such policies form an integral part of these Terms for all legal purposes, even if provided in separate documents. In the event of conflict between these Terms and any Mundpay policy, the provisions of these Terms shall prevail, unless expressly stated otherwise due to legal or regulatory requirements.
These Terms and any updates thereto replace and prevail over any prior understandings, proposals, communications, or agreements, whether verbal or written, entered into between the User and Mundpay.
Data Processing and Information
The User acknowledges and expressly authorizes that their personal and registration data, including identification, contact, banking information, access logs, and transactional data, may be collected, used, stored, and processed by Mundpay in accordance with applicable laws, including Brazil’s General Data Protection Law (LGPD), the Consumer Protection Code, and other applicable regulations, for the purposes of service execution, compliance with legal and contractual obligations, fraud and illicit activity prevention, risk management, governance, and the regular exercise of rights.
The User agrees that such data may be shared, within legal limits, with competent authorities upon formal request, as well as with business, technological, operational partners, financial institutions, insurers, auditors, and service providers when necessary for service provision, security, or auditing.
Data may also be shared with parties directly involved in transactions, disputes, mediations, investigations, or compliance procedures when necessary for fact-finding, conflict resolution, damage prevention, or legal obligations, without prior notice to the User and without generating any right to compensation, provided such actions are taken in good faith and in strict compliance with legal or regulatory duties.
Mundpay undertakes to maintain the confidentiality of information and to adopt appropriate technical, administrative, and organizational measures, in line with market standards, to protect it against unauthorized access, loss, alteration, or improper disclosure.
The User acknowledges that, in the face of legal, operational, regulatory, or reputational risks—including those with potential national or international media impact—Mundpay may use, retain, and, when necessary, share strictly necessary data to protect its rights, institutional image, partners, and third parties. This may include actions to collect outstanding debts, including in cases of negative account balances.
Nothing in this instrument implies waiver of legal rights or assumption of liability beyond legal limits, preserving contractual balance, good faith, and transparency. Detailed information on purposes, legal bases, data subject rights, and security measures is available in Mundpay’s Privacy Policy.
Preservation of Rights and Non-Waiver
Any tolerance, omission, or failure by Mundpay to exercise rights provided for in these Terms, applicable laws, or regulations shall not constitute waiver, novation, or contractual amendment. Mundpay may exercise such rights at any time at its sole discretion, within legal limits.
Any specific waiver of a right shall not imply waiver of other rights, nor affect the enforceability of other provisions of these Terms.
Mundpay’s Activity
The legal relationship between the User and Mundpay will be defined by the group entity effectively contracted to enable Platform access and process transactions, considering jurisdiction, operation nature, and currency.
By accepting these Terms, the User grants Mundpay the necessary powers to perform activities related to maintaining the business relationship, contractual compliance, and adherence to internal and regulatory policies.
Mundpay acts exclusively as a provider of technological and operational services for the intermediation and management of electronic transactions, not performing activities exclusive to financial institutions, nor granting credit, managing cards, accepting deposits, or directly providing financial services.
Regarding operational models:
In Brazil, Mundpay primarily acts as a Marketplace / Intermediation Platform, providing infrastructure to connect Buyers, Sellers, Producers, and Affiliates, enabling transactions without integrating the supply chain.
In the United States and Europe, Mundpay may act as a Merchant of Record (MoR), assuming formal responsibility for financial transaction processing with acquirers, card networks, issuers, and partners, without assuming responsibility for the nature, quality, delivery, or legality of products or services offered.
ETHOCA and VERIFI Alert Services
The Ethoca and Verifi Alert Services, affiliated with the Mastercard network, apply to Mundpay Clients subject to chargeback risks arising from transactions carried out with cardholders.
These services aim to mitigate risks and reduce chargeback rates and consist, exclusively for transactions carried out with Mastercard and Visa cards, of receiving real-time fraud and refund alerts, allowing the Client to take preventive measures.
The Client acknowledges and agrees that all transactions subject to alerts, once received or confirmed, may be automatically refunded. For each refund carried out due to Ethoca or Verifi alerts, a fee of up to BRL 150.00 (one hundred and fifty reais) may be charged, which will be debited upon receipt of the alert by Mundpay.
This fee may be adjusted annually in June based on the positive variation of the IGPM-FGV index accumulated over the previous 12 months or, if discontinued, by another official index that replaces it.
If the Client exceeds a 1% (one percent) chargeback rate, Mundpay may, at its sole discretion, apply additional fees for continued use of payment services, as well as adopt risk mitigation measures, including suspension or deactivation of the account and blocking of funds for up to 120 (one hundred and twenty) days, without prejudice to other penalties provided for in these Terms.
Affiliate Compensation and CPA Payment Conditions
The Affiliate acknowledges that their compensation may occur under two models:
(i) percentage-based compensation calculated on the value of transactions processed through their referral link; and
(ii) fixed compensation per acquisition (CPA — Cost Per Acquisition), subject to a minimum requirement by the Producer/Seller.
CPA payments will only be made when the Producer responsible for the product has accumulated a minimum balance of USD 1,000.00 (one thousand US dollars) in sales of that product on the Platform.
Until this threshold is reached, CPA payments will be suspended, with no compensation or adjustment owed. Mundpay assumes no responsibility for non-payment of CPA during this period.
USER REGISTRATION
User Registration and Eligibility Requirements
Individuals and legal entities may register as Users (Producer, Affiliate, Creator, Co-producer, Collaborator, or Buyer) provided they meet legal requirements and Mundpay policies.
Individuals must be at least 18 years old or legally emancipated. Legal entities must be represented by authorized individuals with sufficient legal powers.
Buyers may register from the age of 13, with authorization from legal guardians for minors between 13 and 18.
Mundpay may refuse or cancel registrations of individuals involved in criminal activities, fraud, money laundering, terrorism financing, or other unlawful conduct.
User Information and Access Credentials
The User declares that all provided information is accurate and assumes full responsibility for it.
Access credentials are personal, confidential, and non-transferable. The User is solely responsible for their security and any activity conducted through their account.
Mundpay is not liable for damages resulting from unauthorized use of credentials.
Registration Verification
Mundpay may take up to 72 business hours to verify user data and may perform additional checks using public or private databases.
Accuracy of Information
The User is fully responsible for the accuracy of their data and any damages resulting from incorrect or misleading information.
Transparency and Third-Party Relationships
Users must provide clear, complete, and transparent information about products and services.
They are fully responsible for third parties involved (partners, influencers, service providers, etc.) and must ensure compliance with laws and Mundpay policies.
Politically Exposed Persons (PEP)
Mundpay does not accept Sellers who are PEPs or related to PEPs.
Users must declare they are not PEPs and must notify Mundpay if this status changes.
Failure to comply may result in immediate account termination and fund retention.
PRODUCT AND SERVICE REGISTRATION
Product Registration and Prohibited Activities
Only legal and compliant products/services may be offered.
Violations may result in immediate freezing of funds and account suspension.
Transparency and Product Claims
False or misleading claims, especially regarding financial gains, are prohibited.
Health-related products must have proper scientific backing and regulatory approvals.
High-Risk Jurisdictions
Mundpay does not operate with sanctioned countries (e.g., Iran, North Korea, Syria, etc.) or individuals on sanctions lists.
Prohibited Uses
Users may not:
Provide false data
Process fake transactions
Use the platform improperly (e.g., as a card testing tool)
Misuse Mundpay’s intellectual property
Platform Integrity
Users must not attempt to hack, manipulate, or exploit the platform.
Spam, malware, or abusive marketing practices are prohibited.
Mundpay Promotion Disclaimer
Mundpay may promote products but does not endorse or guarantee them.
INTELLECTUAL PROPERTY PROTECTION
Mundpay Ownership
All intellectual property related to Mundpay belongs exclusively to the company.
Unauthorized use, reproduction, or exploitation is strictly prohibited.
Brand and Identity
Domain names, trademarks, and visual identity elements are legally protected.
Improper Association
Users may not imply false partnerships, endorsements, or affiliations with Mundpay.
License Granted by Users
Users grant Mundpay a non-exclusive, global, royalty-free license to use content for platform operation and promotion.
Unfair Competition
Users must not engage in deceptive practices, brand imitation, or customer diversion.
Parasitism and Domain Misuse
It is prohibited to:

Engage in cybersquatting or brand bidding

Third-Party Rights
Users are responsible for ensuring their content does not violate third-party rights.

Immediate Measures
Mundpay may suspend or block content immediately in urgent cases.
In such cases, the Notified Party shall not be entitled to any form of compensation and hereby acknowledges and agrees to the terms set forth herein.
The Producer whose infoproduct has been blocked shall be granted the right to submit a subsequent statement, presenting any clarifications and documents deemed relevant, should they consider the measure improper.
REFUNDS
fund requests may be submitted by the Buyer within the product’s guarantee period through the link provided by the platform: https://mundpay.com/ajuda-contato/. If the request is made within the applicable period, it will be processed automatically by the platform.
Mundpay, regardless of prior consultation with or consent from the Producer, reserves the right to intervene and directly issue a refund to the Buyer whenever it identifies circumstances that may compromise proper service delivery, good faith in consumer relations, or the regularity of offers available on the platform.
This prerogative may also be exercised when the Buyer reports lack of response or absence of support from the Producer, as well as in cases where customer support channels are found to be invalid, nonexistent, or inoperative.
Likewise, Mundpay may process refunds in the event of complaints or incidents initiated through administrative, extrajudicial, or judicial channels including, but not limited to, consumer protection agencies or public complaint platforms whenever such occurrences indicate risks to consumer experience, platform reputation, or regulatory compliance.
This measure may also be adopted in cases of suspected or confirmed fraud, plagiarism, copyright infringement, abusive practices, misleading claims regarding product characteristics or results, bad faith conduct, or any similar irregular practices.
Finally, Mundpay may issue refunds in cases of non-delivery, non-availability, or failure by the Producer to comply with delivery or access conditions as advertised.
CHARGEBACKS
Mundpay, as a payment intermediary and participant in the payment ecosystem, adopts risk management, fraud prevention, loss mitigation, and financial integrity protection mechanisms for transactions processed on its platform.
In this context, it reserves the right to retain funds from transactions carried out by the Merchant/Producer for up to 120 (one hundred and twenty) days, through the establishment of an initial financial reserve of 20% (twenty percent) of the transacted amount, intended to cover chargebacks, disputes, refunds, cancellations, and related events.
The retention percentage may be revised and increased, including retroactively, up to 100% (one hundred percent) of the transacted amounts, whenever there are indications of a disproportionate increase in chargeback rates, abnormal dispute levels, abrupt transaction volume changes, or any elements indicating increased operational, financial, or reputational risk.
The adoption of a retroactive reserve aims to safeguard operational sustainability, payment system stability, and the ability to cover contingent liabilities. The release period for any increased reserve will be assessed on a case-by-case basis.
The retention period may also be extended in the event of ongoing judicial, administrative, or arbitration proceedings related to transactions, lasting until final resolution, including final and unappealable decisions. In such cases, retained funds may be used to offset losses, judgments, settlements, legal costs, and attorney fees.
If suspicious, fraudulent, or high-risk transactions are identified—especially where chargeback rates may exceed 1%—Mundpay may proactively cancel sales and issue refunds to Buyers to mitigate systemic risks.
Similarly, if transaction data is found in fraud databases shared within the payment network, Mundpay may immediately reverse the transaction and debit the User’s Virtual Account.
Once a chargeback is formally notified by payment system participants, the full transaction amount will be immediately debited from the Merchant’s Virtual Account, without prior notice.
At Mundpay’s discretion and in compliance with payment network rules, the Merchant may be granted up to 10 (ten) calendar days to submit a defense with supporting documentation proving the legitimacy of the transaction.
Required documentation may include, among others:
Proof of delivery or service provision
Logistics tracking records
Transaction authentication logs (IP, timestamp, device data, etc.)
Evidence of buyer consent
Communication records with the Buyer
Proof of product access or usage
Applicable commercial policies at the time of sale
Any additional documents requested
Failure to submit documentation within the deadline or submission of insufficient evidence will result in forfeiture of the defense and permanent confirmation of the chargeback.
The final decision on disputes rests exclusively with issuers, card networks, and payment institutions, with Mundpay acting only as an intermediary.
If there are insufficient funds, Mundpay may pursue collection measures, including legal action.
The Producer must maintain adequate post-sale support and is aware that Mundpay continuously monitors chargeback rates.
Chargeback rates below 1% are considered acceptable. Exceeding this threshold may result in fund retention for up to 120 days.
Serious violations may lead to account blocking and full fund retention pending investigation.
Investigations may last up to 120 business days, after which a final decision will be communicated.
In case of contract termination, Mundpay may exercise the right of recourse to recover losses.
ACCOUNT SUSPENSION, BLOCKING, AND TERMINATION
Improper use of the platform or violation of these Terms may result in account suspension, blocking, or termination, applied at Mundpay’s sole discretion.
Examples include:

Security breaches
False information
Spam or abusive advertising
Self-purchases via affiliate links
Intellectual property misuse
High chargeback rates
Fraud suspicion
Repeated complaints
Lack of customer support
Measures may be applied without prior notice and do not entitle the User to compensation.
Account removal prevents new transactions, and prior purchases may be refunded.
SUSPENSION
Suspension consists of a preventive and temporary measure, applied when there are indications of irregularities subject to investigation, correction, or clarification. In such cases, Mundpay may limit the User’s access to the Platform, suspend checkout links, sales pages, offers, operational functionalities, and financial payouts, as well as prevent account changes and new transactions.
In cases of suspected fraud, suspension may be applied preventively for up to 120 (one hundred and twenty) business days or for the entire duration necessary for internal investigation. This period may be extended in the event of judicial, police, or administrative investigations, or whenever the complexity of the case so requires.
During suspension, additional risk mitigation measures may be adopted, including retention of funds from suspicious sales, in order to protect consumers, acquirers, payment arrangements, and Mundpay itself.
BLOCKING
Blocking is a more severe measure, applied when there is evidence of a violation, concrete risk of damage, or significant breach of contractual obligations. It may affect specific products or the entire account, resulting in automatic cancellation of listings and offers, interruption of payment processing, prevention of new sales, and blocking of existing and future balances.
Mundpay may block and retain funds from suspicious transactions for the time necessary for investigation, subject to an initial limit of up to 120 (one hundred and twenty) business days, without prejudice to extension for covering chargebacks, disputes, acquirer penalties, refunds, or damages caused.
If acquirers, processors, or financial institutions determine blocks, reversals, or retentions, Mundpay shall fully comply with such determinations and shall not be liable for any resulting damages.
If there are indications of a significant increase in chargeback rates—especially above market standards or with high future risk—Mundpay may, as a preventive measure, cancel sales, interrupt settlements, and issue refunds to Buyers in order to avoid systemic losses.
TERMINATION
Termination results in the definitive closure of the account and contractual relationship and may occur, especially, in cases of confirmed fraud, repeated violations, serious breach of these Terms, significant harm to the Platform or third parties, legal determinations, or conduct that affects the reputation and security of the Mundpay ecosystem.
In cases of confirmed fraud, the account may be blocked and terminated without prior notice, and Mundpay may retain available and future funds to compensate for damages caused to third parties, consumers, acquirers, or the company itself.
When a violation subject to termination is identified, Mundpay will provide formal notice stating the reasons for the measure, subject to legal confidentiality obligations. The User will be granted a deadline to present a defense, defined according to the complexity of the case. After review, Mundpay will issue a final decision within a previously informed timeframe.
Once termination or early contract rescission is enforced, Mundpay may debit the User’s account for any amounts necessary to cover damages caused. Termination will result in permanent access restriction, prohibition of new accounts, and inability to conduct transactions.
REPORTING AND INTERNAL INVESTIGATION
Mundpay may initiate investigation procedures based on reports from users, third parties, or on its own initiative, regardless of external requests. If a report lacks minimum supporting evidence, it may be summarily dismissed.
If deemed plausible, Mundpay may adopt preliminary measures, including preventive blocking of products or accounts, and notify the reported party to present their version of facts, evidence, and clarifications.
When disputes involve conflicts between users, Mundpay may initiate mediation procedures to seek an amicable resolution. If no agreement is reached, Mundpay may, at its discretion and without obligation, issue an administrative decision to resolve the conflict.
Investigations may be initiated at any time, and their results may be shared with competent authorities when required or deemed necessary to protect rights.
DISCLAIMER AND LIMITATION OF LIABILITY
Nature of Services
All services, functionalities, content, systems, software, and materials provided by Mundpay are offered “as is” and constitute obligations of means, not of result. Mundpay does not guarantee performance, continuity, commercial success, profitability, or suitability for any specific purpose.
No Warranties
To the fullest extent permitted by law, Mundpay disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, system compatibility, absolute security, data accuracy, and absence of harmful components.
The User acknowledges that use of the Platform is at their sole risk.
Scope Limitation
Mundpay acts solely as a technological infrastructure provider and intermediary, not creating, endorsing, or guaranteeing any products, services, or content offered by Users.
All offerings are the sole responsibility of the Users.
Exclusion of Liability
Except where legally required, Mundpay shall not be liable for any direct or indirect damages, including loss of profits, data loss, business interruption, or moral damages.
This includes damages arising from:
Product defects or quality issues
False or misleading information
Failure between Users
Delivery issues or cancellations
Chargebacks and payment system rules
Technical failures or cyberattacks
Unauthorized access or fraud
Third-party services

FINAL PROVISIONS
Users may not assign or transfer their rights or obligations without prior written consent from Mundpay.
Right of Recourse and Indemnification
The User agrees to fully indemnify Mundpay for any damages, losses, or expenses resulting from their actions, including legal fees, taxes, penalties, and third-party claims.
This obligation extends to Mundpay’s partners, employees, and representatives.
Failure to enforce any provision shall not constitute waiver of rights.
DISPUTE RESOLUTION
The parties agree to attempt amicable resolution before legal or arbitration proceedings.
Jurisdiction
The courts of Rio de Janeiro, Brazil, are elected as the competent forum.
Governing Law
These Terms are governed by Brazilian law.
ARBITRATION (INTERNATIONAL OPERATIONS)
Disputes related to U.S. or European operations shall be resolved by binding arbitration under the Federal Arbitration Act (FAA), administered by the American Arbitration Association (AAA).

GENERAL TERMS OF USE
GENERAL ASPECTS
Definitions
For the purposes of these Terms of Use, the expressions below shall have the following meanings when used in capital letters, whether in the singular or plural:
Restricted Activities:
A set of activities, practices, products, or services whose execution, offering, or commercialization is prohibited on the Mundpay Platform, pursuant to these Terms of Use, Mundpay’s internal policies, and applicable law.
Chargeback or Dispute:
A request for cancellation, reversal, or refund of a transaction carried out via credit card, submitted by the cardholder to the issuer or card network. The dispute is communicated to the acquirer or sub-acquirer responsible for the transaction, which notifies Mundpay. If the dispute is accepted by the card issuer, the corresponding amount is refunded to the cardholder.
Seller:
An individual or legal entity that uses the Mundpay Platform to sell Digital Products or Services and receive payments resulting from such transactions. The Seller is responsible for the accuracy of the information provided, the delivery of products and services to customers, the legal compliance of its activities, and full compliance with this Agreement.
Affiliate:
An individual or legal entity that, upon authorization from the Seller, promotes or advertises Products or Services through digital marketing strategies, assuming responsibility for its conduct, compliance with applicable rules, and adherence to guidelines established by the Seller and Mundpay. The Affiliate is not part of the contractual relationship between the Seller and Mundpay and is solely responsible for its actions and communications before consumers and authorities.
User:
A broad term designating any individual or legal entity that uses the Mundpay Platform, including Sellers, Affiliates, buyers, or any third party that accesses or interacts with the services made available. Each User is responsible for the accuracy of the information provided, compliance with contractual rules, ethical conduct, and adherence to applicable law.
Affiliate User:
An individual or legal entity that promotes, advertises, or sells third-party digital products, using the Mundpay Platform for processing, intermediation, and management of transactions.
Buyer User:
An individual or legal entity that acquires digital products made available by Producers and/or Affiliates, using the Mundpay Platform for payment processing.
Producer User:
An individual or legal entity that sells digital products owned by them or for which they hold valid authorization for the exploitation of intellectual property rights, using the Mundpay Platform for processing and managing transactions.
Marketplace:
A digital environment operated by a third party where different Sellers can offer their products and services, with Mundpay acting as a payment facilitator, processing transactions and settling amounts due, as applicable. The Marketplace is responsible for its relationship with its Sellers and for the compliance of the offers made on its platform.
Platform:
The technological environment made available and operated by Mundpay, consisting of systems, APIs, interfaces, and other digital resources intended for payment intermediation and processing, financial management, technical support, and other functionalities provided for in this Agreement. It also includes security tools, encryption, and protocols suitable for handling national and international transactions.
Restricted and Prohibited Activities:
A set of activities, products, services, or practices that are prohibited or limited on the Mundpay Platform, in accordance with these Terms of Use, Mundpay’s internal policies, card network rules, regulations of the Central Bank of Brazil, and other applicable laws. The User undertakes to fully comply with such restrictions, under penalty of suspension, retention of funds, or account termination.
Bank Account:
A financial account owned by the User, registered and validated on the Platform, intended to receive funds from transactions processed by Mundpay. The accuracy of the Bank Account data is the sole responsibility of the User.
Fee or Charge:
Compensation owed by the User to Mundpay for intermediation, processing, settlement, risk management, support, and other functions made available on the Platform. Fees are applied in accordance with the current commercial model and the conditions set forth in this Agreement.
Taxes:
Tax obligations applicable to the activities carried out by the User, including taxes, fees, contributions, and other fiscal charges. The calculation, assessment, payment, and tax compliance are entirely the responsibility of the User, with no joint or subsidiary liability of Mundpay.
Transaction:
A financial operation initiated by the Buyer and processed by the Platform, involving authorization, capture, settlement, reversal, dispute, or any related movement, including the principal amount and applicable fees. It is considered completed only after final settlement.
Net Balance:
The amount available to the User after automatic deduction of fees, charges, commissions, amounts owed to Affiliates, refunds, chargebacks, security reserves, blocks, and operational charges.
Security Reserve / Rolling Reserve:
An amount retained by Mundpay preventively or correctively to cover risks of chargebacks, disputes, fraud, penalties, or operational inconsistencies. It may be applied for a fixed or indefinite period, according to risk assessment.
Payout / Transfer / Settlement:
The process by which Mundpay transfers the available Net Balance in the User’s Virtual Account, subject to deadlines, criteria, blocks, minimum amounts, and security conditions set forth in these Terms of Use.
Refund:
A voluntary or compulsory reversal of a transaction, carried out by Mundpay to the Buyer, whether at the request of the Seller, by Mundpay’s decision, or by legal determination, and not to be confused with a chargeback.
KYC (Know Your Customer) / Account Verification:
Identification and document validation procedures required for opening, maintaining, and using the Account, including identity verification, legal documentation, and compliance checks, which may result in account suspension or termination in case of inconsistencies.
Suspicious Transactions:
Atypical movements or those incompatible with the User’s profile, including disproportionate volumes, multiple failed attempts, fraud patterns, misuse of the Platform, high chargeback rates, or potentially unlawful activities, according to objective compliance and risk monitoring criteria.
Maintenance Windows:
Periods previously informed or necessary for updates, performance improvements, bug fixes, security, and technological evolution of the Platform, which may result in full or partial unavailability of services.
Scheduled Downtime:
Temporary interruption of services due to technical, operational, or security needs, either previously communicated or arising from emergency events, not constituting a failure in service provision.
API / Technology Integrator:
A programming interface provided by Mundpay for integration with third-party systems, with the User or developer being solely responsible for proper implementation, maintenance, security, and use of the resources.
Applicability and Acceptance of the Terms
These Terms of Use apply to all websites, digital platforms, systems, interfaces, applications, and other electronic means made available by Mundpay, as well as to all individuals or legal entities who access or use them as Users.
Accessing, browsing, or using any feature of the Platform implies full, express, and unequivocal acceptance of these Terms of Use, which constitute a legally binding agreement between the User and Mundpay. If the User does not agree with any of the provisions herein, they must immediately discontinue access to or use of the Platform.
These Terms govern access to and use of the Platform at both national and international levels, subject to applicable legal, regulatory, technical, and operational limitations. Certain services, features, or resources may not be available in all jurisdictions or to all Users, in accordance with regulatory requirements, internal risk policies, and compliance obligations.
Scope of the Platform and Services
These Terms of Use constitute a legally binding agreement between the User and Mundpay and govern access to and use of the website https://mundpay.com/, its subdomains, as well as any other digital environments, interfaces, applications, systems, or electronic means through which Mundpay makes its products, services, functionalities, and resources available, including applications for mobile devices, tablets, or other electronic equipment. This also includes all services, operations, and functionalities related to or integrated with the Mundpay Platform.
The Mundpay group entity effectively contracted by the User to access the Platform and process transactions may vary depending on the nature of the operation, the country or countries of residence of the User(s), the applicable jurisdiction, and the currency in which the transaction is conducted. For regulatory and contractual transparency purposes, Mundpay has headquarters, branches, and/or representatives in the following jurisdictions:

The identification of the entity responsible for providing services to the User will be defined according to the specific transaction, in compliance with the legal, regulatory, foreign exchange, and compliance requirements applicable in each jurisdiction.
Supplementary Policies
The User declares awareness of and agreement with these Terms of Use, as well as all applicable Mundpay institutional policies, including but not limited to the Privacy Policy, Anti-Money Laundering (AML) policies, Fraud Prevention, Information Security, and other internal compliance rules.
Such policies form an integral part of these Terms for all legal purposes, even if provided in separate documents. In the event of conflict between these Terms and any Mundpay policy, the provisions of these Terms shall prevail, unless expressly stated otherwise due to legal or regulatory requirements.
These Terms and any updates thereto replace and prevail over any prior understandings, proposals, communications, or agreements, whether verbal or written, entered into between the User and Mundpay.
Data Processing and Information
The User acknowledges and expressly authorizes that their personal and registration data, including identification, contact, banking information, access logs, and transactional data, may be collected, used, stored, and processed by Mundpay in accordance with applicable laws, including Brazil’s General Data Protection Law (LGPD), the Consumer Protection Code, and other applicable regulations, for the purposes of service execution, compliance with legal and contractual obligations, fraud and illicit activity prevention, risk management, governance, and the regular exercise of rights.
The User agrees that such data may be shared, within legal limits, with competent authorities upon formal request, as well as with business, technological, operational partners, financial institutions, insurers, auditors, and service providers when necessary for service provision, security, or auditing.
Data may also be shared with parties directly involved in transactions, disputes, mediations, investigations, or compliance procedures when necessary for fact-finding, conflict resolution, damage prevention, or legal obligations, without prior notice to the User and without generating any right to compensation, provided such actions are taken in good faith and in strict compliance with legal or regulatory duties.
Mundpay undertakes to maintain the confidentiality of information and to adopt appropriate technical, administrative, and organizational measures, in line with market standards, to protect it against unauthorized access, loss, alteration, or improper disclosure.
The User acknowledges that, in the face of legal, operational, regulatory, or reputational risks—including those with potential national or international media impact—Mundpay may use, retain, and, when necessary, share strictly necessary data to protect its rights, institutional image, partners, and third parties. This may include actions to collect outstanding debts, including in cases of negative account balances.
Nothing in this instrument implies waiver of legal rights or assumption of liability beyond legal limits, preserving contractual balance, good faith, and transparency. Detailed information on purposes, legal bases, data subject rights, and security measures is available in Mundpay’s Privacy Policy.
Preservation of Rights and Non-Waiver
Any tolerance, omission, or failure by Mundpay to exercise rights provided for in these Terms, applicable laws, or regulations shall not constitute waiver, novation, or contractual amendment. Mundpay may exercise such rights at any time at its sole discretion, within legal limits.
Any specific waiver of a right shall not imply waiver of other rights, nor affect the enforceability of other provisions of these Terms.
Mundpay’s Activity
The legal relationship between the User and Mundpay will be defined by the group entity effectively contracted to enable Platform access and process transactions, considering jurisdiction, operation nature, and currency.
By accepting these Terms, the User grants Mundpay the necessary powers to perform activities related to maintaining the business relationship, contractual compliance, and adherence to internal and regulatory policies.
Mundpay acts exclusively as a provider of technological and operational services for the intermediation and management of electronic transactions, not performing activities exclusive to financial institutions, nor granting credit, managing cards, accepting deposits, or directly providing financial services.
Regarding operational models:
In Brazil, Mundpay primarily acts as a Marketplace / Intermediation Platform, providing infrastructure to connect Buyers, Sellers, Producers, and Affiliates, enabling transactions without integrating the supply chain.
In the United States and Europe, Mundpay may act as a Merchant of Record (MoR), assuming formal responsibility for financial transaction processing with acquirers, card networks, issuers, and partners, without assuming responsibility for the nature, quality, delivery, or legality of products or services offered.
ETHOCA and VERIFI Alert Services
The Ethoca and Verifi Alert Services, affiliated with the Mastercard network, apply to Mundpay Clients subject to chargeback risks arising from transactions carried out with cardholders.
These services aim to mitigate risks and reduce chargeback rates and consist, exclusively for transactions carried out with Mastercard and Visa cards, of receiving real-time fraud and refund alerts, allowing the Client to take preventive measures.
The Client acknowledges and agrees that all transactions subject to alerts, once received or confirmed, may be automatically refunded. For each refund carried out due to Ethoca or Verifi alerts, a fee of up to BRL 150.00 (one hundred and fifty reais) may be charged, which will be debited upon receipt of the alert by Mundpay.
This fee may be adjusted annually in June based on the positive variation of the IGPM-FGV index accumulated over the previous 12 months or, if discontinued, by another official index that replaces it.
If the Client exceeds a 1% (one percent) chargeback rate, Mundpay may, at its sole discretion, apply additional fees for continued use of payment services, as well as adopt risk mitigation measures, including suspension or deactivation of the account and blocking of funds for up to 120 (one hundred and twenty) days, without prejudice to other penalties provided for in these Terms.
Affiliate Compensation and CPA Payment Conditions
The Affiliate acknowledges that their compensation may occur under two models:
(i) percentage-based compensation calculated on the value of transactions processed through their referral link; and
(ii) fixed compensation per acquisition (CPA — Cost Per Acquisition), subject to a minimum requirement by the Producer/Seller.
CPA payments will only be made when the Producer responsible for the product has accumulated a minimum balance of USD 1,000.00 (one thousand US dollars) in sales of that product on the Platform.
Until this threshold is reached, CPA payments will be suspended, with no compensation or adjustment owed. Mundpay assumes no responsibility for non-payment of CPA during this period.
USER REGISTRATION
User Registration and Eligibility Requirements
Individuals and legal entities may register as Users (Producer, Affiliate, Creator, Co-producer, Collaborator, or Buyer) provided they meet legal requirements and Mundpay policies.
Individuals must be at least 18 years old or legally emancipated. Legal entities must be represented by authorized individuals with sufficient legal powers.
Buyers may register from the age of 13, with authorization from legal guardians for minors between 13 and 18.
Mundpay may refuse or cancel registrations of individuals involved in criminal activities, fraud, money laundering, terrorism financing, or other unlawful conduct.
User Information and Access Credentials
The User declares that all provided information is accurate and assumes full responsibility for it.
Access credentials are personal, confidential, and non-transferable. The User is solely responsible for their security and any activity conducted through their account.
Mundpay is not liable for damages resulting from unauthorized use of credentials.
Registration Verification
Mundpay may take up to 72 business hours to verify user data and may perform additional checks using public or private databases.
Accuracy of Information
The User is fully responsible for the accuracy of their data and any damages resulting from incorrect or misleading information.
Transparency and Third-Party Relationships
Users must provide clear, complete, and transparent information about products and services.
They are fully responsible for third parties involved (partners, influencers, service providers, etc.) and must ensure compliance with laws and Mundpay policies.
Politically Exposed Persons (PEP)
Mundpay does not accept Sellers who are PEPs or related to PEPs.
Users must declare they are not PEPs and must notify Mundpay if this status changes.
Failure to comply may result in immediate account termination and fund retention.
PRODUCT AND SERVICE REGISTRATION
Product Registration and Prohibited Activities
Only legal and compliant products/services may be offered.
Violations may result in immediate freezing of funds and account suspension.
Transparency and Product Claims
False or misleading claims, especially regarding financial gains, are prohibited.
Health-related products must have proper scientific backing and regulatory approvals.
High-Risk Jurisdictions
Mundpay does not operate with sanctioned countries (e.g., Iran, North Korea, Syria, etc.) or individuals on sanctions lists.
Prohibited Uses
Users may not:
Provide false data
Process fake transactions
Use the platform improperly (e.g., as a card testing tool)
Misuse Mundpay’s intellectual property
Platform Integrity
Users must not attempt to hack, manipulate, or exploit the platform.
Spam, malware, or abusive marketing practices are prohibited.
Mundpay Promotion Disclaimer
Mundpay may promote products but does not endorse or guarantee them.
INTELLECTUAL PROPERTY PROTECTION
Mundpay Ownership
All intellectual property related to Mundpay belongs exclusively to the company.
Unauthorized use, reproduction, or exploitation is strictly prohibited.
Brand and Identity
Domain names, trademarks, and visual identity elements are legally protected.
Improper Association
Users may not imply false partnerships, endorsements, or affiliations with Mundpay.
License Granted by Users
Users grant Mundpay a non-exclusive, global, royalty-free license to use content for platform operation and promotion.
Unfair Competition
Users must not engage in deceptive practices, brand imitation, or customer diversion.
Parasitism and Domain Misuse
It is prohibited to:

Use confusing brand variations
Engage in cybersquatting or brand bidding
Penalties
Violations may result in:

Third-Party Rights
Users are responsible for ensuring their content does not violate third-party rights.

Immediate Measures
Mundpay may suspend or block content immediately in urgent cases.
In such cases, the Notified Party shall not be entitled to any form of compensation and hereby acknowledges and agrees to the terms set forth herein.
The Producer whose infoproduct has been blocked shall be granted the right to submit a subsequent statement, presenting any clarifications and documents deemed relevant, should they consider the measure improper.
REFUNDS
fund requests may be submitted by the Buyer within the product’s guarantee period through the link provided by the platform: https://mundpay.com/ajuda-contato/. If the request is made within the applicable period, it will be processed automatically by the platform.
Mundpay, regardless of prior consultation with or consent from the Producer, reserves the right to intervene and directly issue a refund to the Buyer whenever it identifies circumstances that may compromise proper service delivery, good faith in consumer relations, or the regularity of offers available on the platform.
This prerogative may also be exercised when the Buyer reports lack of response or absence of support from the Producer, as well as in cases where customer support channels are found to be invalid, nonexistent, or inoperative.
Likewise, Mundpay may process refunds in the event of complaints or incidents initiated through administrative, extrajudicial, or judicial channels including, but not limited to, consumer protection agencies or public complaint platforms whenever such occurrences indicate risks to consumer experience, platform reputation, or regulatory compliance.
This measure may also be adopted in cases of suspected or confirmed fraud, plagiarism, copyright infringement, abusive practices, misleading claims regarding product characteristics or results, bad faith conduct, or any similar irregular practices.
Finally, Mundpay may issue refunds in cases of non-delivery, non-availability, or failure by the Producer to comply with delivery or access conditions as advertised.
CHARGEBACKS
Mundpay, as a payment intermediary and participant in the payment ecosystem, adopts risk management, fraud prevention, loss mitigation, and financial integrity protection mechanisms for transactions processed on its platform.
In this context, it reserves the right to retain funds from transactions carried out by the Merchant/Producer for up to 120 (one hundred and twenty) days, through the establishment of an initial financial reserve of 20% (twenty percent) of the transacted amount, intended to cover chargebacks, disputes, refunds, cancellations, and related events.
The retention percentage may be revised and increased, including retroactively, up to 100% (one hundred percent) of the transacted amounts, whenever there are indications of a disproportionate increase in chargeback rates, abnormal dispute levels, abrupt transaction volume changes, or any elements indicating increased operational, financial, or reputational risk.
The adoption of a retroactive reserve aims to safeguard operational sustainability, payment system stability, and the ability to cover contingent liabilities. The release period for any increased reserve will be assessed on a case-by-case basis.
The retention period may also be extended in the event of ongoing judicial, administrative, or arbitration proceedings related to transactions, lasting until final resolution, including final and unappealable decisions. In such cases, retained funds may be used to offset losses, judgments, settlements, legal costs, and attorney fees.
If suspicious, fraudulent, or high-risk transactions are identified—especially where chargeback rates may exceed 1%—Mundpay may proactively cancel sales and issue refunds to Buyers to mitigate systemic risks.
Similarly, if transaction data is found in fraud databases shared within the payment network, Mundpay may immediately reverse the transaction and debit the User’s Virtual Account.
Once a chargeback is formally notified by payment system participants, the full transaction amount will be immediately debited from the Merchant’s Virtual Account, without prior notice.
At Mundpay’s discretion and in compliance with payment network rules, the Merchant may be granted up to 10 (ten) calendar days to submit a defense with supporting documentation proving the legitimacy of the transaction.
Required documentation may include, among others:
Proof of delivery or service provision
Logistics tracking records
Transaction authentication logs (IP, timestamp, device data, etc.)
Evidence of buyer consent
Communication records with the Buyer
Proof of product access or usage
Applicable commercial policies at the time of sale
Any additional documents requested
Failure to submit documentation within the deadline or submission of insufficient evidence will result in forfeiture of the defense and permanent confirmation of the chargeback.
The final decision on disputes rests exclusively with issuers, card networks, and payment institutions, with Mundpay acting only as an intermediary.
If there are insufficient funds, Mundpay may pursue collection measures, including legal action.
The Producer must maintain adequate post-sale support and is aware that Mundpay continuously monitors chargeback rates.
Chargeback rates below 1% are considered acceptable. Exceeding this threshold may result in fund retention for up to 120 days.
Serious violations may lead to account blocking and full fund retention pending investigation.
Investigations may last up to 120 business days, after which a final decision will be communicated.
In case of contract termination, Mundpay may exercise the right of recourse to recover losses.
ACCOUNT SUSPENSION, BLOCKING, AND TERMINATION
Improper use of the platform or violation of these Terms may result in account suspension, blocking, or termination, applied at Mundpay’s sole discretion.
Examples include:
Restricted activities
Security breaches
False information
Spam or abusive advertising
Self-purchases via affiliate links
Intellectual property misuse
High chargeback rates
Fraud suspicion
Repeated complaints
Lack of customer support
Measures may be applied without prior notice and do not entitle the User to compensation.
Account removal prevents new transactions, and prior purchases may be refunded.
SUSPENSION
Suspension consists of a preventive and temporary measure, applied when there are indications of irregularities subject to investigation, correction, or clarification. In such cases, Mundpay may limit the User’s access to the Platform, suspend checkout links, sales pages, offers, operational functionalities, and financial payouts, as well as prevent account changes and new transactions.
In cases of suspected fraud, suspension may be applied preventively for up to 120 (one hundred and twenty) business days or for the entire duration necessary for internal investigation. This period may be extended in the event of judicial, police, or administrative investigations, or whenever the complexity of the case so requires.
During suspension, additional risk mitigation measures may be adopted, including retention of funds from suspicious sales, in order to protect consumers, acquirers, payment arrangements, and Mundpay itself.
BLOCKING
Blocking is a more severe measure, applied when there is evidence of a violation, concrete risk of damage, or significant breach of contractual obligations. It may affect specific products or the entire account, resulting in automatic cancellation of listings and offers, interruption of payment processing, prevention of new sales, and blocking of existing and future balances.
Mundpay may block and retain funds from suspicious transactions for the time necessary for investigation, subject to an initial limit of up to 120 (one hundred and twenty) business days, without prejudice to extension for covering chargebacks, disputes, acquirer penalties, refunds, or damages caused.
If acquirers, processors, or financial institutions determine blocks, reversals, or retentions, Mundpay shall fully comply with such determinations and shall not be liable for any resulting damages.
If there are indications of a significant increase in chargeback rates—especially above market standards or with high future risk—Mundpay may, as a preventive measure, cancel sales, interrupt settlements, and issue refunds to Buyers in order to avoid systemic losses.
TERMINATION
Termination results in the definitive closure of the account and contractual relationship and may occur, especially, in cases of confirmed fraud, repeated violations, serious breach of these Terms, significant harm to the Platform or third parties, legal determinations, or conduct that affects the reputation and security of the Mundpay ecosystem.
In cases of confirmed fraud, the account may be blocked and terminated without prior notice, and Mundpay may retain available and future funds to compensate for damages caused to third parties, consumers, acquirers, or the company itself.
When a violation subject to termination is identified, Mundpay will provide formal notice stating the reasons for the measure, subject to legal confidentiality obligations. The User will be granted a deadline to present a defense, defined according to the complexity of the case. After review, Mundpay will issue a final decision within a previously informed timeframe.
Once termination or early contract rescission is enforced, Mundpay may debit the User’s account for any amounts necessary to cover damages caused. Termination will result in permanent access restriction, prohibition of new accounts, and inability to conduct transactions.
REPORTING AND INTERNAL INVESTIGATION
Mundpay may initiate investigation procedures based on reports from users, third parties, or on its own initiative, regardless of external requests. If a report lacks minimum supporting evidence, it may be summarily dismissed.
If deemed plausible, Mundpay may adopt preliminary measures, including preventive blocking of products or accounts, and notify the reported party to present their version of facts, evidence, and clarifications.
When disputes involve conflicts between users, Mundpay may initiate mediation procedures to seek an amicable resolution. If no agreement is reached, Mundpay may, at its discretion and without obligation, issue an administrative decision to resolve the conflict.
Investigations may be initiated at any time, and their results may be shared with competent authorities when required or deemed necessary to protect rights.
DISCLAIMER AND LIMITATION OF LIABILITY
Nature of Services
All services, functionalities, content, systems, software, and materials provided by Mundpay are offered “as is” and constitute obligations of means, not of result. Mundpay does not guarantee performance, continuity, commercial success, profitability, or suitability for any specific purpose.
No Warranties
To the fullest extent permitted by law, Mundpay disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, system compatibility, absolute security, data accuracy, and absence of harmful components.
The User acknowledges that use of the Platform is at their sole risk.
Scope Limitation
Mundpay acts solely as a technological infrastructure provider and intermediary, not creating, endorsing, or guaranteeing any products, services, or content offered by Users.
All offerings are the sole responsibility of the Users.
Exclusion of Liability
Except where legally required, Mundpay shall not be liable for any direct or indirect damages, including loss of profits, data loss, business interruption, or moral damages.
This includes damages arising from:
Product defects or quality issues
False or misleading information
Failure between Users
Delivery issues or cancellations
Chargebacks and payment system rules
Technical failures or cyberattacks
Unauthorized access or fraud
Third-party services

FINAL PROVISIONS
Users may not assign or transfer their rights or obligations without prior written consent from Mundpay.
Right of Recourse and Indemnification
The User agrees to fully indemnify Mundpay for any damages, losses, or expenses resulting from their actions, including legal fees, taxes, penalties, and third-party claims.
This obligation extends to Mundpay’s partners, employees, and representatives.
Failure to enforce any provision shall not constitute waiver of rights.
DISPUTE RESOLUTION
The parties agree to attempt amicable resolution before legal or arbitration proceedings.
Jurisdiction
The courts of Rio de Janeiro, Brazil, are elected as the competent forum.
Governing Law
These Terms are governed by Brazilian law.
ARBITRATION (INTERNATIONAL OPERATIONS)
Disputes related to U.S. or European operations shall be resolved by binding arbitration under the Federal Arbitration Act (FAA), administered by the American Arbitration Association (AAA).
Arbitration is individual (no class actions)
Jury trial is waived
Arbitrator has exclusive authority
Costs follow AAA rules
Small claims and urgent court measures remain allowed exceptions.
ARBITRATION OPT-OUT
Users may opt out of arbitration within 30 days of account creation or acceptance of these Terms by submitting written notice including:
Full name or company name
Registered address
Email
Account ID
Explicit opt-out statement
Failure to opt out constitutes full acceptance of arbitration.
Opt-out does not affect access to services but may impact certain features.
